In August of that year, a civil action was filed against him and his other friends for infringing the civil rights of his victims. In April 1988, Wahlberg committed another racist assault at the age of 16. He called a middle-aged Vietnamese-American man in the streets of Dorchester a“Vietnam fucking shit” and knocked him senseless with a big wooden stick. That same day, he assaulted Johnny Trinh, another Vietnamese-American, by punching him in the eye. After his arrest, he was taken to the first scene of the assault and identified the person he had hit saying “…that’s the mother-fucker whose head I split open…” Wahlberg later explained that he had used PCP( a street drug known as angel dust) at the time. Investigators also noted that Wahlberg used uninvited ethnic slurs like “gooks” and “slant-eyed gooks.”
At first, Wahlberg was apprehended for attempted murder. Later, he received two assault counts, battery with a destructive weapon, a count of marijuana possession, and criminal neglect for disobeying the 1986 civil rights injunction. He pleaded guilty to felony assault and received a three-month sentence in jail. However, he only served 45 days of the sentence. Wahlberg thought he had made Trinh permanently blind in one eye after his attack. However, Trinh revealed that he had lost his eye when he served during the Vietnam War.
Wahlberg and Derek McCall fractured Robert Crehan’s, Wahlberg’s neighbor, jaw in August 1992. According to court documents, Wahlberg continually delivered brutal kicks to Robert’s face without provocation while McCall held him down. Wahlberg’s attorney claimed that they were provoked to hit Robert after he called McCall, a black man, a racial slur. They settled the case and avoided a criminal lawsuit.
